Case files, 1820-1970.

Record contains individual case files for every case appealed to the Supreme Court. File material varies greatly and depends both upon case disposition and on Supreme Court document retention rules. However, for cases with a Supreme Court ruling, the court's official opinion forms the record core. Lower court proceeding records include filed briefs and abstracts; evidence and testimony transcripts; motion and petition files; and lower court opinions. Documents filed with the Supreme Court by appellant, appellee, petitioner, or respondent include briefs and reply briefs; briefs amicus curiae; abstracts, additional abstracts, and short record abstracts; notice of intention to file rehearing petition; petitions and motions including rehearing petitions; petition respondent's reply; motion suggestions; affidavits filed in support of motions; counter suggestions and objections to motions; cross motions; proof of service of brief; service abstract and affidivit; declaration of intent to argue orally before the court; application for supersedeas; appearance by attorney or by counsel; and assignment of error (often a part of lower court proceedings). Files also include Supreme Court opinions; Commissioners of Supreme Court reports, approved and promulgated as official court opinion (1927-1933); Supreme Court orders (i.e., rulings on motions; court issued writs); original jurisdiction case testimony transcripts; abstract of agreed facts; stipulations (e.g., agreements between appellee and appellant or petitioner and respondent); and trial record return notices under Rule 42. Files also include Supreme Court justices' incoming correspondence; and the Supreme Court Clerk's correspondence concerning individual cases.
